U.S. Department of Education’s Office for Civil Rights Releases New Resources on Students with Disabilities under Section 504 of the Rehabilitation Act of 1973

On February 20, 2024, the U.S. Department of Education’s Office for Civil Rights released four new fact sheets to inform students, families, and schools about student rights under Section 504 of the Rehabilitation Act of 1973, specifically as it relates to students with asthma, diabetes, food allergies, and GERD.

These resources generally provide information to students and families about Section 504’s prohibitions on discrimination against students with disabilities. The resources also provide examples of how the specific impairments of asthma, diabetes, food allergies and GERD can substantially limit major life activities when considering eligibility under Section 504. The fact sheets further include examples of potential accommodations that students with these impairments may need.

Lastly, these fact sheets describe what a school may need to do to remedy past discrimination.
